Introduction

This privacy policy explains how Di Fox and Tom Howard, collectively referred to as Active-Always Health and Wellbeing or Active-Always (or “we”, “our”, “us”) collect, use and share your personal data.
 

The Categories of Personal Data we Collect and/or Receive

We will process a range of information about you. This may include:

  • name and contact information (such as your home address, email address and telephone number)

  • emergency contact details

  • medical details, injury information and other health related data

  • activity history

  • details of sessions booked/attended and payments made
     

How We Collect and/or Receive Personal Data

We may collect your personal information in a number of ways, principally:

  • Via the Active-Always website, when you complete the contact form or book a session

  • Via the Physical Activity Readiness Questionnaire (PARQ), which you will be asked to complete when you sign up for a session.

  • Via the Personalised Plan Questionnaire, which you will be asked to complete when you express interest in receiving a personalised plan.

  • Via telephone or email if that is how you choose to contact us initially.   In this instance your data may be collected in paper format and then transferred into the PARQ where appropriate.  The paper version will then be securely destroyed.
     

Our Basis for Processing Personal Data and the Purposes for Which We Use It

We use the data that you provide to deliver the information and/or service that you have requested and to ensure that the information and/or service is safe, effective and appropriate to your needs.  We will ask for your explicit consent to collect this data.
 

Who We May Share Your Data With

Data that we collect via the Active-Always website will be processed by Wix.com Ltd in accordance with their Data Processing Agreement, which you can find here: https://www.wix.com/about/privacy-dpa-users.
 

Data that we collect via the Physical Activity Readiness Questionnaire or the Personalised Plan Questionnaire will be stored by SmartSurvey in accordance with their privacy policy, which you can find here: https://www.smartsurvey.co.uk/privacy-policy.
 

In the event that you have a medical emergency during a physical activity session your personal data, health data and emergency contact data may be shared with the Emergency Services.

Your data will not be sold to, or shared with, any other third parties.

 

How Long Will We Store Your Data

We will store your data for seven years, as is required to enable us to respond to any subsequent claims.
 

Your Rights in Relation to Your Personal Data

Under the GDPR, you have the right to:

  • obtain access to, and copies of, the personal data that we hold about you

  • require us to correct the personal data we hold about you if it is incorrect

  • require us to erase your personal data in certain circumstances

  • require us to restrict our data processing activities in certain circumstances

  • receive from us the personal data we hold about you which you have provided to us, in a reasonable format specified by you, including for the purpose of your transmitting that personal data to another data controller

  • object, on grounds relating to your particular situation, to any of our particular processing activities where you feel this has a disproportionate impact on you

  • where our processing is based on your consent, you may withdraw that consent, without affecting the lawfulness of our processing based on consent before its withdrawal.
